Original post by Al-Saqr Al-Wakri: A man passed away, leaving behind twenty gold coins and instructed his brother to give them to his son when he grows up. His uncle sold the gold coins and used the proceeds to start a business. He supported his nephew and his mother. When the son grew up and graduated, he demanded his share of the business. This led to problems and court cases. His guardian uncle insisted on giving his nephew the twenty gold coins that the boy's father had bequeathed to him. The boy, however, wanted the entire business, arguing that the capital was rightfully his, and therefore the business belonged to him. Please advise: Does he have the right to do this, or should he only take the gold?
In the name of Allah, the All Merciful, the Most Merciful, a blessed Ramadan for the Islamic nation and people of humanity altogether, asking Allah to relieve the distress of every oppressed person among the worlds, and a response to the questioners:
The son does not have the fruit of the project, to the fact if the guardian had lost, he would have been obligated to pay the trust that he had; rather, only the orphan has his guaranteed right (twenty (gold) coins), and I ask Allah to make the guardian honorable as he was sufficient and fulfilled his duty, since he was abstinent and did not calculate the orphan’s expenses, clothing, and education, and did not deduct anything from the orphan’s money (which is the twenty (gold) pounds); In fact, I see that he was abstinent.
Accordingly: The guardian is only obligated to pay the insured orphan's money (twenty coins); in fact, he refrained and did not take anything from the orphan's money; consequently, Allah made him not indeed of that, so he refrained. Confirming with the word of Allah the Most High:[Al-Nesã`a ] 4:6
